In brief

You do not need to live in Brazil to have Brazilian tax obligations. Non-resident individuals may still be taxed in Brazil on Brazilian-source income and on certain transactions involving assets located in Brazil.

Who is a non-resident?

Non-resident status depends on Brazil’s residency rules and, for former residents, the circumstances and timing of departure. Nationality is not decisive.

Brazilian-source income

Payments from Brazilian sources to non-residents are generally subject to withholding or definitive taxation under rules that vary by income type. Employment, services, rent, pensions, interest and investments may follow different regimes.

Brazilian real estate

A non-resident can have Brazilian real estate, receive rent and sell property, but rental income and capital gains require specific Brazilian tax analysis.

Brazilian investments

Financial investments can be subject to different regimes depending on the investment and the investor’s registration/status. Bank and brokerage arrangements should reflect the non-resident condition.

Do non-residents file an annual Brazilian return?

The ordinary annual resident income tax return is not the default mechanism for a person who is already a non-resident. Brazilian-source taxes are often collected at source or definitively, but transaction-specific obligations can remain.

Treaties

Where Brazil has an applicable tax treaty with the country of residence, the treaty should be reviewed together with domestic law. A treaty does not automatically eliminate Brazilian tax.

Practical checklist

Country of residence; date non-residency began; Brazilian income; property; investments; payer; local representative/procurator; prior filings; and any planned sale or inheritance.

Conclusion

Non-resident compliance is event-driven. The correct treatment depends much more on the type of Brazilian connection than on whether the individual holds a Brazilian passport.

Technical basis

This content is structured around Brazilian residency/non-residency rules, the Brazilian Federal Revenue’s 2026 individual tax guidance, Normative Instruction SRF 208/2002 and the specific rules applicable to each category of income. Official references should remain linked in the final published version.

FAQ

Can I owe Brazilian tax without living in Brazil?

Yes. Brazilian-source income and transactions involving Brazilian assets can create Brazilian tax obligations.

Do non-residents normally file the resident annual tax return?

The ordinary resident annual return is not the default compliance mechanism once the individual is a non-resident.

Does a tax treaty eliminate Brazilian tax?

Not automatically. The relevant treaty article must be read together with Brazilian domestic law and the facts.
